The Seychelles law recognizes two types of nonprofits. They are;

1. Trusts

The International Trusts Act, of 1994  governs the incorporation of Seychelles trusts. By and large, these types of nonprofits demand that the settler does not reside in Seychelles for the length of the trust. In addition, the International Corporate Service Providers Act license must be held by at least one trustee, according to the Act. This is to assist in offering services as an international trustee.

The trust property does not include any real estate located in Seychelles. Also, according to Seychelles legislation, international trusts registered in the country are not subject to tax on their income, assets, capital gains, or stamp duties. The income or gains from distributions from Seychelles offshore vehicles such as IBCs are also inclusive of tax exemptions.

2. Foundations

The Foundations Act of 2009 governs these types of nonprofits. According to the Act, a foundation is a distinct legal body. These organizations are, therefore, permitted to own property in their own right, unlike trusts. Also, when a foundation’s founder transfers assets to the foundation, the assets become the foundation’s sole possession. However, these assets do not belong to the founder or the beneficiaries.
